ESSENTIAL RIGHTS PROVIDED IN DECREE-LAW NO. 17/2018 OF MARCH 8

Essential information about the planned trip will be communicated to the traveler before the respective contract is concluded.

There is always at least one operator responsible for executing all the services provided for in the contract.

An emergency phone number will be provided to travelers so that they can contact the organizer or the travel agency at any time.

Travelers can transfer the organized trip to third parties, with reasonable prior notice and possible payment of additional costs.

The price of the trip can only be increased in situations where there is an increase in specific costs (such as fuel prices), if this possibility is explicitly stated in the contract and always up to 20 days before the start date of the trip. If the price increase exceeds 8% of the planned trip price, the traveler may terminate the contract. If the organizer reserves the right to increase the price, the traveler will have the right to a price reduction in the event of a reduction in relevant costs.

Travelers can terminate the contract without paying a termination fee and obtain a full refund of payments made in the event of a significant change to any of the essential elements of the organized trip, except for the price. If the operator cancels the trip before it starts, travelers are entitled to a refund and possibly compensation.

Travelers can terminate the contract without paying a termination fee before the trip's start date in exceptional circumstances, such as serious security problems at the destination that may affect the planned trip.

Travelers can terminate the contract at any time before the planned trip's start date, subject to the payment of an appropriate and justifiable termination fee.

If, after the trip has started, significant parts of the trip cannot be fulfilled as agreed, suitable alternative proposals must be presented to the traveler at no additional cost. The traveler can terminate the travel contract without paying a termination fee if the services are not performed as per the contract, and this non-compliance significantly affects the execution of the trip and the organizer does not remedy the issue.

Travelers are entitled to a price reduction and/or compensation for damages in the event of non-compliance or poor performance of travel services.

The organizer must provide assistance if a traveler is in difficulty. If the organizer or retailer is declared insolvent, payments will be refunded.

If the organizer or retailer is declared insolvent after the planned trip has started and transportation is included, repatriation of travelers is guaranteed. Come Na 2 has subscribed to insolvency protection with the Travel and Tourism Guarantee Fund. Travelers can contact this entity or, if applicable, the competent authority (Tourism of Portugal, I.P., Rua Ivone Silva, Lote 6, 1050-124 Lisbon, Tel. 211 140 200 (Call to the National Fixed Network) | Fax. 211 140 830, info@turismodeportugal.pt) if services are refused due to the insolvency of Come Na 2.
